Terms of Service — Skifty

These Terms govern your use of the Skifty mobile app ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Skifty helps people lend and borrow physical items within invite-only groups of people they trust. You create or join a group with an invite code, post items you are willing to lend (or want to borrow), request items from others, and chat to arrange the loan.
Skifty is a platform that connects users. The actual loan of an item is an arrangement directly between the two users involved. Skifty is not a party to that arrangement, does not take possession of any item, does not process any payment (there are no payments in the Service), and is not responsible for the condition, safety, legality, return, or any dispute regarding a lent item.
2. Eligibility and accounts
- You must be at least 16 years old and able to form a binding agreement.
- You register through our authentication provider (Clerk) with an email and password. You are responsible for keeping your credentials secure and for activity under your account.
- One person, one account. Provide accurate information.
3. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or to lend, request, or offer items that are illegal, stolen, dangerous, or that you do not have the right to lend.
- Harass, threaten, defraud, impersonate, or abuse other users.
- Post content that is illegal, infringing, hateful, sexually explicit, or otherwise objectionable.
- Attempt to gain unauthorised access to the Service, other users' data, or our systems; probe, scrape, or disrupt the Service; or circumvent its security or rate limits.
- Use the Service to send spam or unsolicited messages.
We may remove content and suspend or terminate accounts that violate these Terms.
4. Your content
You retain ownership of the content you create (posts, photos, messages). You grant Skifty a limited, non-exclusive licence to host, store, and display that content within the Service to the users entitled to see it (the members of your groups and the parties to your chats), solely to operate the Service.
You are responsible for your content and confirm you have the right to share it. Messages and posts are visible to the relevant other users by design (see the Privacy Policy). Do not share anything you would not want those users to see.
5. Lending between users — no warranty
The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. Skifty does not guarantee that an item offered is available, suitable, safe, or as described, nor that a loan will be honoured or an item returned. Any agreement to lend or borrow is solely between the users involved. Resolve disputes between yourselves; Skifty is not obliged to mediate and is not liable for the outcome.
Nothing in these Terms limits rights you have as a consumer under mandatory Swedish or EU law.
6. Notifications
The Service can send transactional push notifications (e.g. a new message or a request update). These are not required for the Service to function, contain no sensitive content, and you can turn them off in your device settings.
7. Termination and deletion
You may stop using the Service and delete your account at any time, from within the app (or by emailing hello@acoid.com if you can no longer access the app). Deletion removes your data as described in the Privacy Policy §7. We may suspend or terminate your access for violations of these Terms.
8. Limitation of liability
To the maximum extent permitted by law, Skifty and Acoid are not liable for indirect, incidental, or consequential damages, or for any loss, damage, injury, or dispute arising from a loan arranged through the Service or from items lent or borrowed between users. This does not exclude liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, or mandatory consumer rights).
9. Changes to the Service and these Terms
We may change or discontinue features, and we may update these Terms. For material changes we will provide notice in the app. Continued use after changes take effect means you accept the updated Terms.
10. Governing law and disputes
These Terms are governed by the laws of Sweden, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes are subject to the courts of Sweden, subject to any mandatory consumer forum rules. EU consumers may also use the European Commission's Online Dispute Resolution platform.
